About FOIA and the Privacy Act

The Freedom of Information Act (FOIA), 5 USC 552, gives any person the right to request access to records of the Executive Branch of the United States Government. Records must be disclosed unless protected by one or more of FOIA's nine exemptions.

The OCC's disclosure regulation is located at 12 CFR 4. As a bureau of the United States Department of the Treasury, the OCC also complies with Treasury regulations found at 31 CFR Part 1, Subpart A. For further information, visit the Department of the Treasury FOIA site.

The Privacy Act of 1974, 5 USC 552a, allows individuals to gain access to records about themselves that are maintained in a system of records under the control of a federal agency.

To submit a Privacy Act request, your request must:

  • Clearly state that you are making the request under the Privacy Act
  • Provide your full legal name, date of birth, and current mailing address
  • Include verification of your identity
  • Reasonably describe the system of records or the type of records you are seeking

If you are requesting records about yourself, or records contained in a Privacy Act system of records, you must attach the required consent and proof of identity documents to your request before submitting.
